Terms of Use — Imitation Screen

Please read these Terms of Use (“Terms”) carefully before using the Imitation Screen mobile application (“the App”) provided by Artem Kasparian (“we”, “us”, or “our”). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. License
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices that you own or control, in accordance with the Apple Media Services Terms and Conditions and the Usage Rules set forth in Apple’s App Store Terms of Service. This license is granted for personal, non-commercial use only.
2. Apple’s Role
The App is distributed exclusively through Apple’s App Store. The relationship between you and Apple, including the Standard End User License Agreement referenced in the App Store Terms of Service, applies in addition to these Terms. Apple is not a party to these Terms; however, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Apple has no obligation to provide any maintenance or support for the App.
3. Compatibility and Requirements
The App requires an iOS device running iOS 15 or later. Certain functions require an active internet connection, namely: in-app purchases and subscription validation, GDPR / ePrivacy consent management for advertising (where applicable), and the display of ads to free users. All other features — slideshows, color editing, flicker, move, text, Kelvin temperature, and green-screen modes — work offline.
The App is available in multiple languages declared on its App Store page. Localization quality may vary across languages.
4. Subscriptions
The App offers auto-renewable subscriptions (“Subscriptions”) that grant access to premium features. Premium features currently include, but are not limited to:
- An ad-free experience.
- The full Flicker timing controls (dim-hold, bright-hold, and transition pickers on Flicker page 2).
- The multi-color Move sequence editor, with per-step color durations and per-transition crossfade timings.
- The single-color modes on the imitation editor: the Kelvin temperature slider and the green-screen presets.
The specific set of premium features may be expanded or adjusted over time.
- Subscription options: monthly and annual plans, identified inside StoreKit as
io.ksprn.ImitationScreen.premium.monthlyandio.ksprn.ImitationScreen.premium.yearly. The exact title, billing period, and price of each Subscription are shown inside the App prior to purchase and may vary by region and currency. - Payment: payment is charged to your Apple ID at the time of purchase confirmation.
- Auto-renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period at the then-current price for that plan.
- Managing your Subscription: you can manage or cancel your Subscription at any time in your Apple ID account settings (Settings → [your name] → Subscriptions on iOS) or from inside the App by opening the Subscription screen and tapping “Manage Subscription”. Cancellation takes effect at the end of the current billing period; premium features remain available until that period ends.
- Free trial / introductory offers: if a free trial or introductory price is offered, any unused portion is forfeited when you purchase a Subscription.
- Refunds: refund requests are handled by Apple in accordance with Apple’s policies. We are not able to issue refunds directly. To request a refund, contact Apple Support through your purchase history.
- Restoration: Subscriptions purchased on a given Apple ID can be restored on that same Apple ID using the “Restore Purchases” button in the Subscription screen.
5. In-App Purchases
All purchases inside the App are processed through Apple’s StoreKit and are subject to Apple’s billing terms. The App verifies the cryptographic signature (JWS) of each StoreKit transaction locally; if a transaction cannot be verified, the corresponding premium features will not be unlocked.
6. Advertising
The free version of the App displays advertisements served by third-party ad networks (currently Google AdMob). In regions where the GDPR or comparable consent laws apply, the App will request your consent for personalized advertising before any ad is loaded, using Google’s User Messaging Platform. You can reopen the consent dialog at any time from Settings → Privacy options inside the App. See our Privacy Policy for details on what data may be collected by ad partners.
Premium subscribers do not see ads.
7. Acceptable Use
You agree not to:
- Reverse-engineer, decompile, or attempt to extract the source code of the App, except as permitted by applicable law.
- Use the App in any way that violates applicable laws or infringes the rights of others.
- Use any automated means to access, scrape, or interact with the App.
- Use the App for any safety-critical, medical, navigational, or commercial broadcasting purpose. The App is intended for creative, decorative, and entertainment use only.
- Display the App’s flicker or rapidly changing visual effects to other people without their informed consent, in light of the photosensitivity warning in Section 9.
8. Intellectual Property
The App, including all visual designs, source code, animations, color presets, and assets, is owned by Artem Kasparian and protected by copyright and other intellectual property laws. These Terms do not transfer any ownership rights to you. The name “Imitation Screen”, the App icon, and any associated branding are the intellectual property of Artem Kasparian.
Photos and videos that you import into the App remain entirely your property. The App reads them locally and does not claim any rights over them, nor does it transmit them anywhere.
9. Health and Safety Warning (Photosensitivity)
Important. The App contains features that produce rapidly changing visual stimuli, including but not limited to flicker effects (with adjustable speed and amplitude), animated color transitions, moving gradients, and slideshows with fast transitions. Such stimuli may trigger seizures, loss of consciousness, or other adverse reactions in a small percentage of people, including those who have no prior personal or family history of seizures or epilepsy (“photosensitive epilepsy” or “photosensitive seizures”).
By using the App you acknowledge and agree that:
- You will discontinue use immediately if you experience any of the following symptoms: dizziness, blurred or altered vision, eye or muscle twitches, loss of awareness, disorientation, convulsions, or nausea.
- You should consult a medical professional before using the App if you have any history of epilepsy, photosensitive seizures, severe migraines, or related conditions.
- You will not use the App in a way that could expose other people to such stimuli without their informed consent (for example, projecting the screen onto a wall or showing it to a group).
- You will supervise minors who use the App, particularly when flicker, fast move, or fast slideshow modes are active.
- The App is not a medical device and is not intended to diagnose, treat, cure, or prevent any condition.
10. Device Care
Continuous, prolonged display of bright or static visuals may, over time, cause image retention or burn-in on OLED and other emissive display technologies. To reduce this risk:
- Avoid leaving the App running at maximum brightness for extended uninterrupted periods, especially on a single static color.
- Prefer the slideshow, flicker, or move modes over a fully static color when running long sessions.
- Lower your device’s brightness when full brightness is not needed.
We are not responsible for any device damage, image retention, accelerated screen wear, battery drain, or thermal effects caused by the use of the App. Use the App responsibly with respect to your device.
11. Disclaimer of Warranties
The App is provided “as is” and “as available”, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy of color reproduction or temperature simulation, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
The App’s color, flicker, Kelvin-temperature, and green-screen effects are visual approximations only; they are not calibrated and must not be relied upon for any professional, medical, scientific, photographic-color-reference, or industrial purpose.
12. Limitation of Liability
To the maximum extent permitted by law, in no event shall Artem Kasparian be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including without limitation damages for lost profits, lost data, device damage, image retention or burn-in, or any health-related consequences described in Section 9.
In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability is limited to the maximum extent permitted by law.
13. Termination
We reserve the right to modify, suspend, or terminate the App, any feature, or any Subscription tier, at any time and for any reason, including but not limited to your violation of these Terms. Your license under Section 1 terminates automatically upon any breach. You may terminate at any time by uninstalling the App; cancellation of Subscriptions is governed by Section 4.
14. Changes to the Terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the current version. Material changes will be highlighted in the App or on this page. Continued use of the App after a change constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles. Any dispute arising under these Terms shall be brought in the competent courts of the Netherlands, subject to any mandatory consumer protection rules in Section 16.
16. EU Consumer Rights
Nothing in these Terms limits any mandatory consumer rights granted under applicable European Union or Dutch consumer protection laws. If you are a consumer resident in the European Union, you may also use the European Commission’s online dispute resolution platform at https://ec.europa.eu/consumers/odr.
